Qualified Domestic Relations Orders

A qualified domestic relations order (“QDRO”) is an order made pursuant to state domestic relations law that assigns to an alternate payee the right to receive all or a portion of benefits payable to a retirement plan participant.  A QDRO must include certain information and meet specific requirements pursuant to the Internal Revenue Code (“IRC”) and the Employee Retirement Income Security Act (“ERISA”).

In many divorces, a spouse’s retirement plan must be divided according to the parties’ settlement agreement or a court order.  To do this, a QDRO is required.

Ms. Shircliff will work with the parties and the retirement plan administrator to prepare a domestic relations order, see to its entry by the state court, and ensure its qualification by the plan administrator.  Many divorce attorneys do not provide this service for their clients, so if you are a plan participant, an alternate payee, or an attorney with a client in need of a QDRO, please contact Ms. Shircliff to learn more about her QDRO preparation services.
